1. The Binding Agreement (Total Acceptance)

By accessing this website, placing an order, or making a payment to Booth Multi-Purpose Grease (“the Company”), you (the “Customer”) enter into a final and legally binding contract. These terms override any verbal discussions with staff or third parties. If you do not agree with these terms, you must not proceed with any transaction.

2. Product Application & Technical Disclaimer

Customer Duty of Care: Booth Multi-Purpose Grease is an industrial lubricant. The sole responsibility for determining the compatibility of this grease with any specific engine, bearing, or machine lies with the Customer.

Exclusion of Mechanical Liability: The Company is not liable for any mechanical failure, engine seizure, or equipment damage resulting from improper application, mixing with other brands, or use in non-specified machinery.

Illustrations: Website images are for reference. Actual can or sachet designs may vary. No claim shall be entertained based on aesthetic differences between the website image and physical stock.

3. Absolute Shipping & Third-Party Logistics Waiver

To protect the Company from the risks of Nigerian infrastructure:

Third-Party Handover: All deliveries are performed by independent third-party logistics providers. Booth Multi-Purpose Grease is not liable for any delay, failed delivery, or loss once the goods are handed over to the courier.

No "Inconvenience" Claims: The Customer waives all rights to sue or claim damages for "loss of time" or "business downtime" due to logistics delays.

Destination Selection: Selecting the wrong delivery zone results in a forfeited, non-refundable fee. Rerouting requires a new payment.

4. Finality of Payment & Refund Exclusion

No Refunds After Delivery: Once the product has been dispatched or delivered, NO CASH OR BANK REFUNDS will be issued under any circumstances.

Pre-Delivery Change: Customers may only change or exchange a product before it has left the Company's premises at Aspanda.

Bank Transfers: Account details are provided on-screen. No order is confirmed until funds are fully cleared in the Company’s account.

5. Return & Technical Sovereignty (5-Day Limit)

Factory Defects only: Returns are only considered for verifiable factory faults. All such claims must be made within 10 days of purchase.

Seal Integrity: No return or exchange will be considered if the factory seal on a can or sachet has been broken, tampered with, or shows signs of attempted opening.

Final Decision: The Company’s technical team has the exclusive and absolute right to approve or reject a claim. Their decision is final and non-negotiable.

6. Limitation of Liability & Indemnity

Financial Cap: The maximum total liability of the Company for any claim whatsoever (whether in contract or tort) shall not exceed the actual purchase price paid for the specific goods in question.

Indemnification: The Customer agrees to indemnify and hold Booth Multi-Purpose Grease harmless from any legal suits or costs arising from the Customer's misuse of the product or breach of these terms.

7. Governing Law & Mandatory Dispute Resolution

Jurisdiction: This agreement is governed by the laws of the Federal Republic of Nigeria.

Mandatory Mediation: Before any litigation can be commenced in a Nigerian court, the parties must attempt to resolve the dispute via mediation in Lagos for a minimum of 30 days.

Venue: Any legal proceedings shall be held exclusively in the courts of Lagos State.
